SUSTRACCIÓN INTERNACIONAL DE MENORES

 

Una sustracción internacional de menores se produce cuando un menor es trasladado o retenido, ilícitamente, en otro país por uno de sus progenitores. Ilícitamente significa, en este caso, que se ha infringido el derecho de custodia, tuición o visita del país en el que el menor tenía su residencia habitual o se ha actuado sin consentimiento del otro progenitor.

 

Nuestro estudio ha tramitado con éxito causas relativas a sustracción de menores que habían sido trasladados a Chile, desde el extranjero. Obteniendo sentencia favorable en el Tribunal de Familia y Corte de Apelaciones, en Chile.

 

INTERNATIONAL CHILD ABDUCTION

An international child abduction occurs when a child is removed or retained illegally in another country by a parent. Illegally it means, in this case, which has infringed the right of custody, custody or visiting the country in which the child was habitually resident or has acted without consent of the other parent.
